As I was browsing down my Facebook feed today. I saw a video which piqued my interest as it shows men with high-powered firearms barging into someone’s home and mauling one of its residents. It also shows that this video was uploaded last Saturday by the victim’s cousin whose name is ‘Winmae Micarsos‘ and according to her this was a police raid in Talamban, Cebu. The worst part is that when the police arrived brandishing their high-powered firearms whilst there’s a woman who appeared to be carrying an infant in the vicinity. Here’s the video.
WATCH: A policeman in white shirt forcibly shoved the woman carrying the baby aside in minute 0:17:13 and even hitting the baby’s head with the rifle in the process
As I watched the video I saw one of the policemen wearing white shirt ”shoved” the woman aside with his sharp shoulder possibly hitting the infant’s head as he was trying to nudge her out of the way. I find this very inappropriate and dangerous as the woman could have lost her balance and the child falling from her grasp. This is very irresponsible for the Philippine National Police as such rash and drastic action could have cost the life of this innocent little child.
There’s been hundreds and thousands of innocent fatalities resulting from a raid just like this. Many were killed in the cross-fire as if our streets are no longer safe. Anyone can be killed by flying bullets or rampaging lawless police force whose only desire is to maim and kill innocent civilians. The saddest part is that more than three years ago – this was not supposed to be this way. And it’s really sad that many don’t really realize the important judicial safeguards which protect us from abusive cops or military forces. Sadly, we won’t really appreciate the value of human rights until a member of our family fell victim to it.
This is a warrantless raid
The worst part of this is that the supposed police raid did not have any proper court orders or in short a ”warrant”. Now, just to for your information that anyone can’t be jailed or have their properties taken or searched without a court order. This is very important since that protects us from being unlawfully detained or even people in power asking a bunch of goons in PNP to raid our homes and plant drugs or weapons. This illegal and a direct violation of our rights under the 1987 Constitution.
Section 2. The right of the people to be secure in their persons, houses, papers, and effects against unreasonable searches and seizures of whatever nature and for any purpose shall be inviolable, and no search warrant or warrant of arrest shall issue except upon probable cause to be determined personally by the judge after examination under oath or affirmation of the complainant and the witnesses he may produce, and particularly describing the place to be searched and the persons or things to be seized.
So you see? The cops came in in full battle gear wielding high-powered weapons and even to the point of endangering an infant’s life but didn’t really have the proper documents to impose such raid anyway? How was this even called a legitimate police operation when clearly this is illegitimate?
Cebu Mayor Tommy Osmeña has since issued statements and demanded an explanation from the Cebu City Police regarding the incident. Though the PNP released statements that this was actually a legitimate police operation but were seemed to be unable to show proper court documents to back their claim.
